These are the terms for booking a place on one of my landscape photography workshops. I've kept them as short and plain as I can. Please read them before you book. If anything isn't clear, just email me.
The workshops are run by Nigel Danson, trading through Capture Landscapes Limited, a company registered in England and Wales ("I", "me", "we").
You book a place by paying the deposit shown on the workshop page. Your booking is confirmed once the deposit has been received, and at that point these terms form the contract between us. Deposits are non-refundable, because once your place is confirmed I turn other people away and commit to accommodation and planning.
The full balance is due 3 months before the workshop starts. I'll send you a reminder beforehand. Bank transfer is preferred; I can also send you a card payment link if that's easier.
If the balance hasn't been paid by the due date, I'll get in touch first. If it still isn't paid, I may release your place and treat the booking as cancelled by you, under section 3 below.
If you book less than 3 months before the workshop, the full price is payable when you book.
Please tell me by email as soon as you can. The date I receive your email is the date of cancellation.
Refunds are paid back the way you paid, normally within 14 days.
Places can't be transferred to another person or moved to another workshop unless this has been specifically agreed with me in advance and in writing.
I strongly recommend taking out travel insurance that covers cancellation, as soon as you book.
The usual 14-day right to cancel online purchases doesn't apply to workshop bookings. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (regulation 28(1)(h)), it doesn't cover leisure services provided on a specific date or period. My cancellation terms in section 3 apply instead.
Weather is part of landscape photography, and some of the best light comes in "bad" weather, so workshops go ahead in most conditions. I'll adapt locations and timings to make the most of whatever we get.
Occasionally I may have to cancel, for example because of illness, too few bookings, or conditions that make the workshop unsafe. If that happens, you can choose a full refund of everything you've paid, or move to another date.
I can't be responsible for travel, accommodation or other costs you've arranged yourself, so I'd advise flexible or refundable bookings, and insurance.
Exactly what's included is listed on each workshop's page. For my Lake District residential workshops it includes:
Evening meals are not included in the price (we eat at local pubs or in the cottage). Insurance, travel to and from the workshop, drinks and personal expenses aren't included either.
Lake District workshops have a maximum of 4 people, so everyone gets proper time with me.
The itinerary is a plan, not a promise. I may change locations, timings or the order of days because of weather, light, tides, access or safety. That's normal on a landscape workshop and isn't a reason for a refund.
Workshops involve walking on uneven, wet and sometimes steep ground, early starts and late finishes, often in cold or wet weather. Please make sure you're fit enough, and tell me before the workshop about any medical condition, injury or mobility issue that could affect you.
Everyone must fill in the details form and sign the activity waiver before the workshop. You'll get a private link to both after booking.
On the day, my decisions about safety are final. If I think a location, route or activity isn't safe for you or the group, we won't do it. You must follow reasonable safety instructions. If your behaviour puts you or others at risk, I may ask you to leave the workshop without a refund.
You're responsible for your own camera gear and belongings throughout the workshop, including in vehicles and at the accommodation. Please make sure they're insured.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited or excluded under UK law.
Otherwise, I'm not responsible for losses that weren't foreseeable, or for business losses.
These terms don't affect your statutory rights as a consumer, including under the Consumer Rights Act 2015, which requires me to provide the workshop with reasonable care and skill.
The photos you take on the workshop are yours. I may take photos of the group during the workshop and use them on my website, YouTube or social media. If you'd rather not appear, just tell me and I won't use any where you can be recognised.
How I use and look after your personal information is explained in my privacy notice.
If something isn't right, please tell me during the workshop so I can try to sort it straight away, or email me afterwards. I'll reply within 14 days.
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
I may update these terms from time to time. The terms that apply to your booking are the ones on this page when you booked.
